For builders, the slowest part of a megaproject often isn’t the build. It’s the wait for a federal sign-off. The SPEED Act wants to shrink that wait, and after clearing the House it’s now the Senate’s problem.
The bill passed the House 221-196 with a bipartisan sponsor pair, Bruce Westerman of Arkansas and Jared Golden of Maine. It targets the National Environmental Policy Act, the 1969 law that governs environmental review of major federal actions. The mechanics matter to anyone who’s watched a project sit in review for years. SPEED narrows which actions trigger NEPA at all, compresses review timelines, and shortens the window in which opponents can sue.
What permitting reform would change on the ground
That last piece, the litigation window, is the one contractors care about most. A finished environmental review isn’t worth much if a lawsuit can freeze the job for two more years. Transmission lines, pipelines, transit tunnels, and large renewables all carry the same risk, and projects like the Hudson Tunnel show how review and litigation can stretch a timeline well past the engineering.
SPEED arrives on top of a year of executive action. The Council on Environmental Quality finished removing its NEPA implementing regulations, effective in January, and the USDA consolidated seven separate agency NEPA rules into one, cutting its regulatory volume by about two-thirds. The direction is consistent even when the methods differ.
The Senate math
Here’s the catch. The Senate’s Environment and Public Works leaders, Republican Shelley Moore Capito and Democrat Sheldon Whitehouse, have signaled interest in a permitting deal, but not necessarily the House text. Clean-energy advocates warn that faster reviews cut both ways, speeding fossil and renewable projects alike, and some worry the litigation limits go too far. The window is political too. Leadership could shift after the 2026 midterms, and a deal not done by then may not get done. For an industry that plans in decades, the permitting fight is still being measured in months.
