It was routine roadwork. Around 9:45 on the morning of July 28, on northbound Interstate 135 about three miles south of Salina, Kansas, a 2000 Dodge Ram 3500 left the travel lanes. It struck a legally parked vehicle, skidded into the guardrail, overturned, and hit five construction workers standing behind it.
Toby Marco, 55, of Abilene, was pronounced dead at the scene. He was a construction inspector for Lochner, the Chicago-headquartered engineering firm. Four other workers were injured. Two were critical and were flown to hospitals in the Wichita area.
The protected side isn’t
The detail that should stop every safety manager reading this is where the workers were standing. Behind the guardrail. That is the position work zone plans treat as safe, the place you put people when you can’t shut the lane. A guardrail is designed to redirect a vehicle traveling roughly parallel to it at a shallow angle. It is not designed to stop a pickup that has already left the roadway, hit something, and started rotating.
This is the scenario that positive protection barriers and buffer space are supposed to cover, and it’s the gap between what a traffic control plan shows on paper and what the geometry actually does at 70 miles an hour. Portable concrete barrier, shadow vehicles with truck-mounted attenuators, and real longitudinal buffer all cost money and lane time. Guardrail is already there and costs nothing.
Inspection staff carry the same exposure as craft
Marco was an inspector, not an operator or a laborer. Owner’s representatives, surveyors and inspectors spend their days in work zones without necessarily being covered by the contractor’s site-specific safety plan or included in its daily briefings. They’re often standing where the work isn’t, which is exactly where protection tends to be thinnest. If your project has consultant staff walking the job, they belong in the traffic control plan by name, not by assumption.
Timing in Washington
The crash lands while AGC and ARTBA are pushing to get work zone safety provisions into surface transportation reauthorization. The current authorization runs out September 30. Whatever gets written into the next bill on positive protection, automated enforcement and buffer requirements will govern how thousands of these setups get designed for the next five years.
Work zone intrusion is not a rare event and it is not an unsolvable one. It’s a funding and specification question that gets decided in traffic control plans long before anyone puts on a vest. Anyone running phased work on a live facility, including projects like the Reno-Tahoe airport concourse rebuild where operations continue through construction, is making the same category of decision about where people stand and what’s between them and moving vehicles.
